Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Pep Talk mobile application and related services (the “App”), operated by Gradient Descent Labs, a division of Gradient Descent LLC (“Pep Talk,” “we,” “us,” or “our”). Please read them carefully. By downloading, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy.
1. Acceptance of Terms
By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the App. If you are using the App on behalf of another person, you represent that you are authorized to accept these Terms on their behalf.
2. Eligibility
Pep Talk is intended solely for adults aged 18 years or older. By using the App, you represent and warrant that you are at least 18 years old and legally able to enter into these Terms.
3. Health & Medical Disclaimer
You acknowledge and agree that:
- Pep Talk does not create a doctor–patient relationship, and no content in the App is intended as a recommendation to use, purchase, or administer any peptide, compound, or substance.
- Many peptides and research compounds are not approved by the U.S. Food and Drug Administration (FDA) or other regulators for human use, may be regulated or restricted in your jurisdiction, and may carry serious health risks.
- You should always consult a qualified, licensed healthcare professional before starting, changing, or stopping any protocol, supplement, medication, or health regimen, and before acting on any information in the App.
- Reconstitution calculations, dose figures, blood-level estimates, and scan analyses are estimates for educational purposes and may be inaccurate. You are solely responsible for verifying any figure before relying on it.
- You use the App and any information within it entirely at your own risk. If you think you may have a medical emergency, call your doctor or emergency services immediately.
4. AI Features
The App includes AI-powered features, including a research assistant and face/body scan analysis, provided with the help of third-party AI services (see our Privacy Policy). AI outputs are generated automatically, may be inaccurate, incomplete, or misleading, and must not be relied upon as medical, clinical, legal, or professional advice. By using these features, you consent to the processing of the content you submit by our AI providers to generate responses and analyses.
5. Accounts & Registration
To use most features, you must create an account by signing in with Apple or Google. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
6. Subscriptions, Billing & Auto-Renewal
Pep Talk offers optional paid subscriptions that unlock premium features. Subscriptions are sold and billed through the Apple App Store and processed via our subscription-management providers.
- Payment is charged to your Apple ID account upon confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription, and turn off auto-renewal, in your Apple App Store account settings.
- Except where required by law, payments are non-refundable; refund requests for App Store purchases are handled by Apple under its policies.
- Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation;
- Use the App to sell, solicit, promote, or facilitate the sale of any controlled substance, prescription drug, or illegal product;
- Post content that is unlawful, harmful, harassing, hateful, defamatory, fraudulent, sexually explicit, or that infringes others' rights;
- Impersonate any person or misrepresent your affiliation with any person or entity;
- Attempt to reverse engineer, decompile, interfere with, or gain unauthorized access to the App or its systems;
- Use automated means to scrape, harvest, or collect data from the App; or
- Provide medical advice to other users or hold yourself out as a licensed professional unless you are one and clearly identify as such.
8. User Content, Community & Moderation
You retain ownership of the content you submit (“User Content”), including community posts, comments, and images. By submitting User Content, you grant Pep Talk a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate and provide the App.
You are solely responsible for your User Content and represent that you have the rights to submit it. Community content reflects the views of individual users, is often anecdotal, and is not medical advice or evidence.
Zero tolerance for objectionable content and abusive behavior. We do not tolerate content or users that are abusive, harassing, threatening, hateful, sexually explicit, or otherwise objectionable. To keep the community safe, we provide the following in-app tools:
- Filter — automated and manual filtering to screen objectionable content before or after it is posted.
- Report — every post, comment, and user profile can be reported from within the App.
- Block — you can block another user at any time, which hides their content and prevents them from interacting with you.
- Delete — you can delete your own posts and comments at any time.
We review reports of objectionable content and abusive users and act on credible reports within 24 hours by removing the content and, where appropriate, suspending or ejecting the user. To report content or a user outside the App, email hello@trypeptalk.com.
9. Intellectual Property
The App and its content — including software, design, text, graphics, logos, research summaries, and compilations of data — are owned by Gradient Descent LLC or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App for your own non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from the App except as expressly permitted.
10. Third-Party Services
The App integrates third-party services, including cloud hosting, AI processing, authentication, health data integration, subscription management, and notification delivery. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or content, and links or references to third parties do not constitute an endorsement.
11. Disclaimer of Warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any information (including calculations, estimates, AI outputs, or research summaries) is accurate, complete, or reliable.
12. Limitation of Liability
To the fullest extent permitted by law, in no event will Gradient Descent Labs, Gradient Descent LLC, or their officers, members, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or health outcomes, arising out of or relating to your use of (or inability to use) the App, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Gradient Descent Labs and Gradient Descent LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your User Content, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
15. Apple App Store Additional Terms
These Terms are between you and Pep Talk (Gradient Descent LLC), not with Apple. You acknowledge that:
- Apple has no obligation to provide maintenance or support for the App;
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
- Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims;
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property claim relating to the App;
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming, except where prohibited by applicable law.
17. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
